Plant Breeder's Rights Act, 2007 (No. 18 of 2007).

This Act makes provision for the definition, registration and protection of plant breeder s rights and sets out conditions and procedures for the assignment of such right and related denomination of plant varieties. The Act also designates the Seed Control and Certification Institute of the Ministry of Agriculture as the plant variety protection authority.
Plant breeder s rights shall be registered in accordance with this Act with that authority. As for plant variety trails, where the Institute determines that a plant variety is genetically modified, the Institute shall refer that variety to the National Biosafety Authority and the provisions of the Biosafety Act, 2007, shall apply to that variety. The Institute may designate a Plant Genetic Resource Centre as a centre for storage and maintenance of germplasm material for the purpose of this Act and may order the grantee of the rights to cause a specified quantity of propagating material of that variety to be delivered, at the expense of the grantee, to a specified plant genetic resource centre or a herbarium.
